Terms of Use

1. Introduction and Acceptance
These Terms of Use ("Terms") are a legal agreement between you and Zoom Games Ltd ("Zoom Games", "we", "us", "our"), a company registered in England and Wales under company number 17259532, with our registered office at 17 Eaton Park Road, Cobham, England, KT11 2JJ.
They apply to the website at zoomxi.app (the "Website") and the ZoomXI mobile application for iOS and Android (the "App"), together "the Services". By creating an account or otherwise using the Services, you agree to these Terms. If you do not agree to them, please do not use the Services. Please also read our Privacy Policy, which explains how we handle personal information and forms part of this agreement.
2. Eligibility
ZoomXI is a football quiz suitable for all ages, but it is not directed at children, and you must be 13 or over to create an account. In some countries the minimum age may be higher, depending on local law. If you are under the age of majority where you live, you may only use the Services with the involvement of a parent or guardian.
3. Your Account
Some features require an account, which you can create directly or via a third-party sign-in provider (e.g. Apple or Google). You're responsible for keeping your account credentials secure and for all activity that happens under your account. Let us know as soon as possible at privacy@zoomxi.app if you believe your account has been compromised.
You may also use parts of the App as a guest, without creating an account. Guest progress is stored on your device and is not guaranteed to be recoverable if you uninstall the App or switch devices — creating an account lets us keep your progress safe.
4. Licence to Use the App
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the App on a device you own or control, solely for your own personal, non-commercial entertainment. All rights not expressly granted to you are reserved by Zoom Games or our licensors.
You must not, and must not allow anyone else to:
- copy, modify, or create derivative works of the Services;
- reverse engineer, decompile, or attempt to extract the source code of the App, except where applicable law permits it;
- remove, obscure, or alter any proprietary notices on the Services; or
- rent, lease, sublicense, resell, or otherwise make the Services available to any third party.
5. Gameplay, Virtual Currency, and In-App Purchases
The App may offer virtual currency (e.g. coins), consumable in-app purchases, and an auto-renewing subscription pass, each shown with its price, content, and duration (and any introductory or trial terms) before you buy. Purchases are processed by Apple's App Store or Google Play, and their respective terms and payment methods apply to the transaction itself; we do not receive or store your payment card details.
- Auto-renewing subscriptions renew automatically for the same duration and at the then-current price unless you cancel at least 24 hours before the end of the current period. Manage or cancel a subscription through your App Store or Google Play account settings — we cannot cancel it on your behalf.
- Virtual currency and in-app items have no monetary value, cannot be exchanged for cash, and are non-transferable between accounts.
- All purchases are final and non-refundable except where required by law or by Apple's/Google's own refund policies, which are handled directly by them.
- We may adjust prices, rewards, or the coin cost of features from time to time; changes won't affect a purchase you've already made.
6. Footballer Photographs and No Endorsement
The quiz works by progressively revealing a zoomed-in photograph of a professional footballer, together with factual hint information such as their name, nationality, and club. These photographs are used under a copyright licence from IMAGO, a professional sports and press photo agency.
Other than co-founder Peter Crouch, the footballers who appear in the quiz have not endorsed or sponsored ZoomXI, and their inclusion is solely for identification and entertainment purposes. Nothing in the Services implies any partnership, sponsorship, or affiliation between Zoom Games Ltd and any other footballer, club, league, or players' association. If you are a featured footballer, or someone authorised to act on their behalf, and have concerns about how a photograph is used, see Section 5.2 of our Privacy Policy for how to raise it with us.
7. Peter Crouch's Image and Likeness
Peter Crouch, a co-founder of ZoomXI, has given his permission for his image and likeness to be used in ZoomXI's advertising and marketing materials.
8. Acceptable Use
When using the Services, you agree not to:
- cheat, exploit bugs, use automation, bots, or other unauthorised third-party software to gain an unfair advantage;
- use an offensive, impersonating, or misleading username or profile detail;
- harass, abuse, or harm other players, or attempt to access another user's account without permission;
- use the Services for any unlawful purpose, or in a way that infringes anyone else's rights; or
- interfere with or disrupt the Services, including their security or related systems.
We may suspend or remove access for anyone who breaches this section.
9. Leaderboards and Other Users
If you use features such as leaderboards or friends, other users may see your username, score, and streak. Don't share anything in a username or profile detail that you wouldn't want visible to other players.
10. Intellectual Property
The Services, including their software, design, quiz format, graphics, and branding (but excluding licensed footballer photographs, which remain the property of IMAGO and the relevant rights holders), are owned by or licensed to Zoom Games Ltd and are protected by intellectual property laws. Nothing in these Terms transfers any of that ownership to you.
11. Third-Party Services
The Services rely on third parties including Apple, Google, and cloud hosting and analytics providers, as described in our Privacy Policy. We aren't responsible for the availability or content of third-party services, and your use of them (e.g. an App Store account) is governed by their own terms.
12. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, express or implied, as to the accuracy, reliability, or availability of the Services, and we don't guarantee that the App will be uninterrupted, timely, secure, or error-free. Nothing in this section limits any warranty which cannot lawfully be excluded, including under UK consumer protection law.
13. Limitation of Liability
To the fullest extent permitted by law, Zoom Games Ltd will not be liable for any indirect, incidental, or consequential loss, or for loss of data, profits, or opportunity, arising from your use of the Services. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot lawfully be limited or excluded.
14. Indemnity
You agree to indemnify Zoom Games Ltd against any claims, losses, or expenses arising from your breach of these Terms or your misuse of the Services, except to the extent caused by our own breach or negligence.
15. Suspension and Termination
We may suspend or terminate your access to the Services if you breach these Terms, or if we reasonably believe it's necessary to protect the Services or other users. You can stop using the Services, or ask us to delete your account, at any time by contacting privacy@zoomxi.app. Sections of these Terms that are intended to survive termination (including Sections 10, 12, 13, and 14) will continue to apply.
16. Changes to the Services or These Terms
We may update the Services or these Terms from time to time. Where we make material changes to these Terms, we'll take reasonable steps to notify you (for example, via the App or an in-app notice) before the change takes effect. Continuing to use the Services after a change takes effect means you accept the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. If you're a consumer, you may also benefit from any mandatory protections given by the law of the country you live in, and either of us can bring proceedings in relation to these Terms in the courts of England and Wales, or in the courts of your country of residence if you're a consumer based elsewhere in the UK or EEA.
